
J.G. Petrucci has agreed to a stipulation permanently withdrawing the warehouse proposal
Buckingham Township Board of Supervisors are pleased to announce that they have secured J.G. Petrucci’s agreement to a stipulation that will withdraw the warehouse use proposal in favor of a limited residential development of the land. At the direction of the Board of Supervisors, the Township’s legal team has been working on a stipulation by which Petrucci would agree to withdraw its warehouse proposal in favor of the residential use Petrucci proposed and we announced in September.
As outlined in the stipulation, the proposed warehouse project will be replaced by a much smaller residential plan that better reflects Buckingham’s character and community vision. The stipulation which the Township introduced will, once fully executed and approved by the Bucks County Court, end all litigation and permanently withdraw the warehouse application with prejudice. The property, currently zoned for industrial use, will instead allow no more than 40 single-family homes, consistent with neighboring properties and preserve 26 acres of open space.
To correct a misconception, this stipulation is not a bait and switch that would allow the warehouse plan to resurface. Rather, the stipulation, if signed by all parties, would require, “Petrucci shall withdraw, with prejudice, the Petrucci Application upon Petrucci’s receipt of final, unappealable approval of the Residential Proposal in accordance with this Stipulation.” The Court would retain jurisdiction “to insure and enforce compliance by the Parties with the terms of this Stipulation.”
Buckingham Township provides this update on the ongoing negotiations to permanently end the warehouse proposal and will continue to keep the community informed.
