Relief Requested:       The Application requests variances from §2302.B of the Zoning Ordinance to permit the canopy to encroach into the 25 foot front yard along York Road by 10.8 feet at its widest point; from §3013 to permit parking in the front yard of the Property along both Swamp and York Roads and to allow for existing vegetation to remain as the required buffers; and a special exception, if required to permit the non-conforming Gasoline Service Station use to have a convenience store in place of the repair shop as permitted by Section 405.E.23.L of the Zoning Ordinance.

Relief Requested:       The Application requests variances from §802.A.2, which requires a maximum 10% building coverage where 11.3% is proposed; variances from §802.A.2 and §405.C1.B, which require a 40 foot and 50 foot side yard setback, respectively, where 3.7 feet is proposed; a variance from §405.C1.B, which requires a 100 foot building setback from a Residential District, where 3.7 feet is proposed; a variance from §405.C1.D, which requires 193 parking spaces where 96 exist; a variance from §3100.B.11, which requires 100% preservation of perimeter vegetation within 100 feet of property lines, where 95% is proposed; a variance from §3303.A to extend or increase a dimensional or parking nonconformity.
