The regular meeting of the Buckingham Township Board of Supervisors was held November 14, 2018 in the Township Building, 4613 Hughesian Drive, Buckingham, Pennsylvania.

Mrs. Rash called the regular meeting to order at 7:30 p.m.

 

 

PUBLIC COMMENT

 

No Activity.

 

BOARD’S ANNOUNCEMENTS

 

Mrs. Rash made the following announcements:

-   Free Leaf Waste bags are available at the township building. Bags will be picked up during the   

    last week of November or they may be brought to the Township Maintenance Garage at 4991    

    Upper Mountain Road on Saturday, December 1st from 10am to 12 noon. 

The Administrative Offices of Buckingham Township will be closed November 22 and 23 for 

    the Thanksgiving Day Holiday.

The November 28, December 12 and December 26 Board of Supervisor Work Sessions and

    Regular Business Meetings have been cancelled.  There will be a Work Session and Regular    

    Business Meeting on Wednesday, December 19th, and the annual Reorganization Meeting 

    (including a Regular Business Meeting) will take place on January 7, 2019.

Annual Township Tree Lighting Event: Friday, December 7th beginning at 6:00 p.m.

Red Cross Blood Drive: Tuesday, December 18th from 12 to 5pm in the township building. Call

            REQUESTS FOR PAYMENT, PAYROLL and BILL LIST

 

Consideration of approving Payment Request No. 9, to Eastern Environmental Contractors, Inc. for work completed on the Fieldstone Spray Field Upgrades – General Contract BT-17-01, in the amount of $48,690.00.

 

Mrs. Rash made a motion, seconded by Mr. Forest to approve Payment Request No. 9, to Eastern Environmental Contractors, Inc. for work completed on the Fieldstone Spray Field Upgrades – General Contract BT-17-01, in the amount of $48,690.00. The motion carried unanimously.





Consideration of approving Payment Request No. 2, to Derstine Company, LLC, for work completed on the Buckingham Village WWTP 2017 Plant Upgrades – General Contract BT-17-04, in the amount of $148,500.00.

 

Mrs. Rash made a motion, seconded by Mr. Forest to approve Payment Request No. 2, to Derstine Company, LLC, for work completed on the Buckingham Village WWTP 2017 Plant Upgrades – General Contract BT-17-04, in the amount of $148,500.00. The motion carried unanimously.

 

Consideration of approving Payment Request No. 11, to A.H. Cornell & Sons Inc., for work completed on the Holicong Park Expansion, Phase 1, Contract 2016-04, in the amount of $125,688.48.  

           

Mrs. Rash made a motion, seconded by Mr. Forest to approve Payment Request No. 11, to A.H. Cornell & Sons Inc., for work completed on the Holicong Park Expansion, Phase 1, Contract 2016-04, in the amount of $125,688.48. The motion carried unanimously.

 

Consideration of approving Payroll for the weeks ending October 28, 2018 and November 11,  2018, and the Bill List for the meeting of November 14, 2018.

 

Mrs. Rash made a motion, seconded by Mr. Forest to approve Payroll for the weeks ending October 28, 2018 and November 11, 2018, and the Bill List for the meeting of November 14, 2018 in the total amount of $1,141,931.08. The motion carried unanimously.

 

MINUTES

 

Consideration of approving the draft Supervisors’ Minutes of the October 24, 2018 Work Session and October 24, 2018 Regular Business Meeting.

 

Mrs. Rash made a motion, seconded by Mr. Forestto approve, as most recently presented, the draft Supervisors’ Minutes of the October 24, 2018 Work Session and October 24, 2018 Regular Business Meeting. The motion carried unanimously.

 

Consideration of accepting various Departmental Minutes and Advisory Body Minutes.

 

Mrs. Rash made a motion, seconded by Mr. Calderaio to accept the following Departmental Minutes and Advisory Body Minutes:

 

- Code Enforcement Monthly Statistical Report – October 2018

- Planning Commission – September 5, 2018

- Park and Recreation Commission – September 12, 2018 and October 10, 2018

 

The motion carried unanimously.

 

 

BUSINESS

 

Consideration of posting the Proposed 2019 Budget for Buckingham Township.

 

Mrs. Cozza presented the proposed 2019 budget and displayed a slide show showing expenditures and revenues. Mrs. Cozza confirmed that Buckingham Township’s taxes will not increase from 2018. Mrs. Rash commented that Buckingham Township has one of the lowest township tax rates in Bucks County.

 

Mrs. Rash made a motion, seconded by Mr. Calderaio to approve posting the Proposed 2019 Budget for Buckingham Township.

 

The motion carried unanimously.

 

Consideration of accepting the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Contract to December 1, 2019 for the “Gash Tract” Subdivision, Township File SA 2004-04.

 

Mrs. Rash made a motion, seconded by Mr. Forest to accept the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Contract to December 1, 2019 for the “Gash Tract” Subdivision, Township File SA 2004-04. The motion carried unanimously.

 

Consideration of accepting the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Contract to December 13, 2019, covering “Phillips Tract (Surrey Hill)”, Township File SA 2002-06A.

 

Mrs. Rash made a motion, seconded by Mr. Forest to accept the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Contract to December 13, 2019, covering “Phillips Tract (Surrey Hill)”, Township File SA 2002-06A. The motion carried unanimously.

 

Consideration of accepting the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Agreement to December 17, 2019, covering “Pine Crest Farm, Lot 2”, Township File SA 2010-03.

 

Mrs. Rash made a motion, seconded by Mr. Forest to accept the Request for Extension of the time to complete the Improvements as set forth in the Residential Development Agreement to December 17, 2019, covering “Pine Crest Farm, Lot 2”, Township File SA 2010-03. The motion carried unanimously.

 

Consideration of accepting the Request for Extension of the time to complete the Improvements as set forth in the Stormwater Facility Development Contract to November 15, 2019 between Vincent Rongione, III and Karen Rongione, Magnum, Inc. and Buckingham Township for the property located at 4527 Church Road, TMP 6-10-72.

 

Mrs. Rash made a motion, seconded by Mr. Forest to accept the Request for Extension of the time to complete the Improvements as set forth in the Stormwater Facility Development Contract to November 15, 2019 between Vincent Rongione, III and Karen Rongione, Magnum, Inc. and Buckingham Township for the property located at 4527 Church Road, TMP 6-10-72. The motion carried unanimously.

 

Consideration of approving Resolution No. 2369, a Resolution of the Board of Supervisors of Buckingham Township, Bucks County, Pennsylvania, Affirming the Acceptance of Improvements in the Development of Lands Known as Sycamore Hollow Farms Consisting of the Common Improvements and the Lot No. 3 Residential Lot Improvements, Township File LD 2010-01.

 

Mrs. Rash made a motion, seconded by Mr. Forest to approve Resolution No. 2369, a Resolution of the Board of Supervisors of Buckingham Township, Bucks County, Pennsylvania, Affirming the Acceptance of Improvements in the Development of Lands Known as Sycamore Hollow Farms Consisting of the Common Improvements and the Lot No. 3 Residential Lot Improvements, Township File LD 2010-01.

 

Mr. Smith explained that the amounts stated in the proposed resolution are higher than what they would be in today’s development agreements due to a change in law that now says the township should only retain maintenance amounts for the “dedicated improvements” that the township will have responsibility for. Mr. Smith said the Board has the option to keep the original contractual amounts or to lower them to an amount consistent with the recent changes to the Municipalities Planning Code.

 

Mr. Gray explained that following his review of the project, he suggests a reduced maintenance period security amount of $8,620.74 for the common site improvements (from $20,196.80), and keeping the original $28,832.67 amount for the Lot 3 site improvements. Mr. Gray said he has also prepared the associated escrow releases to bring the financial security on hand down to the maintenance period balances, and they are scheduled for review later during this meeting.

 

Mrs. Rash amended the motion, seconded by Mr. Forest, to include that the Common Site Improvements maintenance amount shall be reduced to $8,620.74 from $20,196.80, and the Lot 3 maintenance amount shall remain set at $28,832.67, for a total security amount of $37,453.41 to be held during the dedication maintenance period.

 

The motion carried unanimously.

Mrs. Rash made a motion, seconded by Mr. Forest, to approve Escrow Release 7A, Site, for “Four Seasons”, Township File SA 2008-03, in the amount of $8,290.29 to be released to Buckingham Township for payment of outstanding fees owed. The motion carried unanimously.

$29,031.90 recommended for release – Final Escrow Release

 

Mrs. Rash made a motion, seconded by Mr. Forest, to approve Escrow Release 7B, Site, for “Four Seasons”, Township File SA 2008-03, in the amount of $29,031.90, Final Escrow Release.

 

Mr. Gray confirmed that all items are complete for the “Four Seasons” subdivision and he recommends a final release of the funds that were held as security during the dedication maintenance period. The motion carried unanimously.

ADDITIONAL BUSINESS / MANAGER’S ITEMS

 

Consideration of authorizing township staff to order an appraisal of the property located at Tax Map Parcel # 06-018-094.

 

Mrs. Rash made a motion, seconded by Mr. Forest, to approve authorizing township staff to order an appraisal of the property located at Tax Map Parcel # 06-018-094. The motion carried unanimously.

 

Consideration of approving the Bill of Sale between Toll PA, L.P. and Buckingham Township for the “Arbor Point (aka Villages at Buckingham)” Sanitary Sewer and Water Mains and Off-Site Improvements to the Township’s Sewer System and Water System, Township File SA 99-02A in anticipation of and conditional upon the acceptance of dedication of the improvements at Arbor Point.
